Contract
Fair Use and Customer Experience
At Penistone Camper Hire, we want every hirer to enjoy a safe, enjoyable and memorable camper van
experience.
These terms and conditions are intended to clearly explain the responsibilities of both Penistone Camper Hire
and the hirer, ensuring a fair and transparent hire experience for everyone.
We will always endeavour to provide a well maintained vehicle, accurate information and reasonable
assistance should any issues arise during your hire. Whilst every effort is made to ensure your vehicle and
equipment are fully operational, camper vans are complex vehicles and occasional faults or issues may occur
despite regular maintenance and inspections.
We ask all hirers to treat the vehicle and its contents with care, follow the guidance provided, and contact us
as soon as possible should any concerns arise during the hire period so that we can provide assistance where
possible.
This contract for self drive hire is between Firth Campers Ltd trading as Penistone Camper Hire (from hereon in
referred to as Penistone Camper Hire, we, us) and the person making the booking – the hirer.
No other party is subject to the contract, regardless of whether they have contributed to the payment of any
costs.
The contract and hire insurance commence only when Penistone Camper Hire allow you, the hirer, to take
possession of the keys to the vehicle, and then only when:
• A signed rental agreement is in place
• You have provided the required documentation to us as requested
• Full payment has been received by us
• The security deposit has been received by us from the authorised driver
• You have met all of the rental conditions and criteria as per our terms and conditions
By taking possession of the keys to the vehicle, you agree to enter into a contract with us and agree to:
• Accept our terms and conditions and the rental agreement terms and conditions
• Rent the vehicle for the hire period as stated on the rental agreement
• Pay all rental fees before taking possession of the vehicle
• Accept responsibility and pay for any relevant charges and fees, damage, theft, tolls, parking, traffic
fines or any other charges, including court costs
• Complete the report for the internal and external inspection of the vehicle at the start and end of the
hire period
We reserve the right to refuse any booking placed by you at any time prior to accepting the booking with no
explanation.
Payment
To secure a booking, a non-refundable 25% deposit is required.
The remaining balance is due 6 weeks prior to your rental period start date.
Bookings made within 6 weeks of the rental start date require payment in full at the time of booking.
The reservation is only binding once Penistone Camper Hire confirms it by email and the 25% deposit has been
paid.
No vehicle will be released without full payment having been received within the time frame specified.
Security Deposit
A security deposit of £750 is required 3 days prior to commencement of hire.
This payment will be automatically taken using the payment card used to make the booking.
The security deposit will be refunded within 7 days of the end of the hire period, following a final inspection by
Penistone Camper Hire, providing the terms of the rental have been met and subject to the below:
• The camper van is returned at the agreed time (late charge of £50 per hour applicable)
• The camper van is returned to us clean and in the same condition as it was at the start of the hire
period, including pots, pans, crockery and utensils (cleaning charge of £15 per hour applicable if not
cleaned to a satisfactory standard)
Cancellation
The non-refundable 25% deposit will be charged for cancellations made more than 6 weeks before the hire
start date.
Cancellations made within 6 weeks of the hire start date will result in 100% loss of the full cost of the hire.
Upon booking your hire, we advise you to take out your own travel insurance to cover unforeseen
circumstances which may result in cancellation, as we do not offer refunds for this as per our terms and
conditions.
Cancellation by Penistone Camper Hire due to unforeseen circumstances
In the event of a vehicle becoming unusable or damaged prior to your hire and we are unable to provide a
substitute vehicle, you will be entitled to either a change of hire date or a refund in full.
We are not liable for any travel costs, charges, campsite bookings, missed functions or any other charges paid
by you.
We are not liable for adverse weather conditions, breakdown or theft affecting any hire.
Force Majeure
In the unforeseen circumstances that the UK Government impose mandatory restrictions on travel caused by
events that are outside the control of Penistone Camper Hire, including but not limited to:
Acts of God, flood, drought, earthquake, war, terrorism, hurricane or acts of government contributing to
making the planned hire impossible, Penistone Camper Hire will enforce their standard cancellation policy.
In addition, the hirer will be entitled to either defer their booking (to be taken within 12 months) or receive a full
refund.
In the event of force majeure arising mid-hire, we will recall the vehicle as soon as it is possible to do so.
Hirers are advised to ensure appropriate travel insurance is in place prior to the start of hire.
Breakdown
The hire vehicle is covered for breakdown and Penistone Camper Hire will provide you, should you require it,
with the details for contacting the breakdown assistance provider.
In the event of the vehicle being unrepairable and unable to continue the hire, the vehicle will be recovered
back to Penistone Camper Hire and the hirer will be refunded on a daily pro-rata basis for any unused hire
period.
We are not liable for any missed events, bookings, functions or other costs incurred by the hirer as a result of
breakdown.
Vehicle, Habitation Equipment and Repairs
The hirer must notify Penistone Camper Hire as soon as reasonably possible if any fault, damage, malfunction
or issue occurs with the vehicle, habitation equipment, fixtures, fittings or contents during the hire period.
The hirer must not attempt to repair, arrange repairs, authorise any work or incur any costs relating to the
vehicle or its equipment without prior written consent from Penistone Camper Hire.
Any unauthorised repairs or expenditure may not be reimbursed.
In the event of a fault occurring during the hire period, Penistone Camper Hire will provide reasonable
assistance and guidance and, where appropriate, arrange for repairs or remedial action to be carried out.
The hirer acknowledges that camper vans contain complex mechanical, electrical, plumbing and habitation
systems which may occasionally develop faults despite regular servicing, maintenance and inspection.
Whilst Penistone Camper Hire makes every effort to ensure all vehicles and equipment are maintained to a
high standard, we cannot guarantee that every component, appliance or feature will remain fully operational
throughout the hire period.
Where a fault occurs which does not affect the safe use of the vehicle, Penistone Camper Hire will make
reasonable efforts to assist and resolve the issue where possible.
Each situation will be considered individually and, where appropriate, Penistone Camper Hire may offer a
goodwill gesture, partial refund or other suitable remedy depending on the circumstances and the impact on
the hirer’s enjoyment of the hire.
Where a fault occurs which affects the safe operation of the vehicle or significantly impacts the continuation
of the hire, Penistone Camper Hire will take reasonable steps to assist, including arranging repair, recovery or
alternative solutions where possible.
Any refund or compensation offered will be considered on a case by case basis, taking into account the
circumstances and the impact on the hirer.
Penistone Camper Hire is not liable for any additional costs incurred by the hirer as a result of faults, repairs or
breakdowns, including but not limited to travel costs, accommodation, campsite fees, missed events,
bookings or other consequential losses.
The hirer remains responsible for any damage, loss or repair costs arising from misuse, negligence, failure to
follow operating instructions, accidental damage or failure to report an issue promptly.
Procedure of Hire
Upon collection of the vehicle from Penistone Camper Hire, both Penistone Camper Hire and the hirer will
jointly inspect the vehicle’s condition and contents and sign to confirm this has been carried out and agreed.
Upon return of the vehicle to Penistone Camper Hire, both Penistone Camper Hire and the hirer will jointly
inspect the vehicle’s condition and contents and sign to confirm it has been returned in the same condition it
was at the start of hire.
The procedure for rectifying any damage to the vehicle or its contents will be as stated in these terms
and conditions.
Penalties and Fines
Drivers are responsible for all fines and charges issued during the hire period.
These include, but are not limited to: all parking fines, toll charges, towing charges, traffic fines or charges,
speeding fines, clamping costs, or any other charge or fine not listed.
For your safety and security, the vehicle is equipped with a front and rear facing dash cam that records video
footage while the vehicle is in use.
Please note that, in compliance with data protection and privacy regulations, the dash cam does not record
any audio.
All recordings are used solely for safety, security and incident review purposes and are handled in accordance
with applicable data protection laws.
Driver Requirements
Our insurer requires that all drivers (maximum of 2 per hire):
• Are aged between 25 and 79 years
• Have held a valid driving licence for at least 2 years with UK Category B entitlement, which must be
produced at the start of hire
• Must be present at the time of collection and handover of the vehicle without exception
• Have their current up to date home address on their driving licence
• Whose licence was issued outside of the EU or Commonwealth must supply a standard licence at the
time of hire. This licence must have been issued in the country where their standard licence was
issued and must confirm that they are entitled to drive a UK Category B vehicle
• Must provide all requested identification and documentation on collection of the vehicle
Failure to do this or meet all driver requirements as set out in our terms and conditions will result in Penistone
Camper Hire being unable to release any vehicle and no refund will be given.
Drivers must declare any motoring or criminal convictions or claims within the last 5 years at the time of
booking.
No more than 1 insurance claim/fault or outstanding incident in the last 5 years allowed.
Penistone Camper Hire cannot accept drivers with more than two convictions with a maximum of 3 points per
conviction (only certain convictions are covered under our insurance, please contact us prior to booking to
advise of any endorsements).
Drivers must sign and complete the booking form immediately before hire and provide all required
identification.
The camper van must only be driven by the hirer or other permitted driver who has also completed and signed
the booking form and provided the required identification and documentation.
The camper van may only be driven within the agreed hire period and is only insured for use during this period.
NO REFUND WILL BE GIVEN IF HIRE IS CANCELLED DUE TO US BEING UNABLE TO INSURE YOU TO DRIVE.
Driver Identification
Our insurer requires that all drivers (maximum of 2 per hire) provide the following documentation 7 days prior
to the start of hire:
• Driving licence photocard – must show current home address (must also be produced at time of
booking and start of hire)
• National Insurance number
• Online DVLA check code
• Two different proofs of address which must be dated within 90 days of the hire start date and match
the address on the driving licence
Proofs of Accepted Address (2 required)
Please note – covering letter alone is not accepted.
Accepted documents include:
• Utility bill – electric/gas/water
• Broadband/landline bill
• Council Tax bill (annual bill accepted)
• Bank/Credit Card statement
• Mortgage statement
• Polling card
• HMRC Self Assessment/Tax Credit documentation
• Student Loan documentation
• Payslip
• Mobile phone bill
• Pension letter
• Car finance statement
• Loan statement
Please note copies of all identification provided will be kept for 7 years for the purpose of, but not limited to,
the defence of any legal claims.
Failure to meet any of the above requirements may result in you being unable to hire the camper van.
Please contact us directly before booking to declare any endorsements, motor claims/accidents and any
medical conditions or restrictions imposed by a doctor or GP.
Insurance
Providing you and any authorised driver are in compliance with our rental agreement, subject to our terms and
conditions, limitations, exceptions and exclusions under our comprehensive self drive hire insurance provided
by our insurer, fully comprehensive self drive hire insurance is included in your rental fee.
Details of this can be provided if requested.
The insurance excess is £750 and forms the security deposit taken prior to hire. This will be returned at the end
of hire subject to meeting our standard terms and conditions.
Removable contents and extras are not covered by our insurance policy and, if damaged or not returned at the
end of the hire period, will be charged for by way of retaining the security deposit or part thereof.
In the event of loss or damages being in excess of the security deposit, the hirer will be liable to pay any
additional charges to replace lost or damaged items.
In the event of theft of the vehicle during the hire period, the hirer will be liable for the full cost of the vehicle.
A claim will be made with our insurer once the theft has been reported to Penistone Camper Hire and the police.
The keys must be returned to Penistone Camper Hire until the insurer advises on the status and acceptance of
the claim and agrees to reimburse Penistone Camper Hire for the cost of the vehicle, in which case the hirer
will be liable for the £750 excess of the claim.
The hirer is fully liable for any replacement or repair of windscreen, tyre or alloy wheel damage.
Personal belongings are not covered by our insurer.
Travel Insurance
It is the responsibility of the hirer to provide their own insurance to cover personal belongings, personal injury
and cancellations.
Due Care of the Vehicle
Throughout the hire period, the hirer is responsible for the vehicle, its contents and equipment and as such is
expected to take due care of it.
The hirer is required to familiarise themselves with the vehicle operating manual and any other information
provided prior to hire. By accepting the vehicle keys, the hirer confirms that they have been shown how to use
the vehicle and that they will be liable for any repairs or costs arising from damage caused by misuse,
negligence or failure to follow the instructions provided.
Smoking or vaping is not permitted in the vehicle.
The vehicle must not be used for dangerous, offensive, noxious, noisy, illegal or immoral activities or any act
that could reasonably be considered annoying or a nuisance to anyone else.
The key must not be left in the ignition, inside the vehicle or in view when not in use to prevent theft.
The hirer is responsible for replacement of lost keys.
The hirer is responsible for ensuring the correct fuel is used and for any costs incurred to rectify incorrect
fuelling.
The hirer must drive on suitable public roads and campsites.
Penistone Camper Hire reserves the right to enforce restrictions on vehicle movement in some areas due to
road conditions, weather conditions or any other reasonable cause.
The hirer is fully liable for any damage caused to the underside of the vehicle due to driving on unsuitable
terrain.
The hirer must drive within the requirements of the law and the Highway Code.
The hirer is not permitted to make any alterations or additions to the vehicle.
The vehicle must not be used for any illegal activity, race, rally, contest or as a tow vehicle or for hire or reward.
The hirer is responsible for monitoring the vehicle throughout the hire period and, in the event of any problems,
must contact Penistone Camper Hire as soon as reasonably possible.
The hirer will not be reimbursed for any expenditure incurred in rectifying the vehicle without prior written
consent from Penistone Camper Hire.
In the event of an accident, loss or damage to the vehicle, the hirer must notify Penistone Camper Hire and the
police where required, and obtain names and addresses of any third parties or witnesses.
The hirer must ensure correct operation when putting up and taking down the pop-top roof to avoid damage to
the roof or canvas.
The hirer will be liable for any costs incurred to repair any damage found to be due to incorrect operation or
misuse.
The hirer must ensure the awning is only erected in calm weather and must never be erected in windy
conditions.
The awning must not be left erected whilst the vehicle is unattended.
The hirer will be liable for any costs incurred to repair any damage found to be due to non-compliance or
misuse of the awning.
Use of Vehicle Outside the United Kingdom (European Travel)
The following terms apply where the hirer intends to take the vehicle outside of the United Kingdom.
Prior Authorisation
The vehicle may not be taken out of the United Kingdom without the prior written consent of Penistone Camper
Hire.
Any unauthorised travel outside of the United Kingdom will constitute a breach of this agreement and may
invalidate insurance cover.
Approved Countries
Where permission is granted, travel is restricted to countries approved by Penistone Camper Hire.
These will typically include European Union countries but may exclude certain countries at our discretion.
Travel to any unapproved country is strictly prohibited.
Notification of Travel and Crossings
The hirer must provide full details of intended travel prior to departure, including (but not limited to) countries
to be visited and details of any ferry or Channel crossings.
This is required to ensure appropriate insurance cover and documentation is in place.
Insurance and Documentation
European travel is subject to appropriate insurance cover being arranged and confirmed by Penistone Camper
Hire.
The hirer must comply with all insurance terms and conditions at all times.
Where required, Penistone Camper Hire will provide a VE103 certificate or equivalent documentation
authorising the use of the vehicle abroad.
The hirer must carry all required documents when travelling.
Security Deposit for European Travel
Where permission is granted for European travel, an additional security deposit of £250 will be added to the
standard UK security deposit.
This additional amount will be held for the duration of the hire and refunded following the safe return and
inspection of the vehicle, provided no losses, damage or breaches of this agreement have occurred.
Responsibility for Fines, Tolls and Charges
The hirer is solely responsible for all tolls, road charges, fines, penalties, parking charges, congestion charges
and other costs incurred whilst travelling outside of the United Kingdom.
Penistone Camper Hire reserves the right to charge an administration fee of £25 for processing any such
charges.
Compliance with Local Laws
The hirer is responsible for complying with all road traffic laws and regulations in each country visited,
including requirements relating to safety equipment and vehicle use.
Breakdown, Accident or Damage Abroad
In the event of breakdown, accident or damage occurring outside of the United Kingdom, the hirer must notify
Penistone Camper Hire immediately.
Penistone Camper Hire will advise on the next steps regarding contacting the relevant insurer or breakdown
provider.
The hirer must follow all instructions provided.
Restrictions on Use
Penistone Camper Hire reserves the right to restrict or prohibit travel to certain events or locations where there
is an increased risk to the vehicle or occupants.
Pets
Dogs are welcome to travel with you at no additional cost provided that:
• You notify us at the time of booking of any dog travelling with you
• You have no more than 2 small to medium dogs
• You do not allow your dog on the seat, bed or furniture and provide your own dog bed on the floor for
your furry friend
• You do not leave your dog unaccompanied in the vehicle at any time
• You return the vehicle to us in a clean condition, free of dog hair, dog smells or damage caused by your
dog
Please note, if the vehicle is not returned to us in a clean and satisfactory condition, cleaning costs as per our
terms and conditions may be incurred.
Liability
The hirer may be required to pay a cleaning fee as detailed within these terms and conditions if the vehicle or
any of its contents are not returned in a clean and satisfactory condition.
Any fines, penalties, charges or accidents not reported at the time of return which subsequently result in costs
or administration charges being incurred by Penistone Camper Hire will be considered a breach of this
agreement and will remain payable by the hirer.
Privacy and Data Protection
Penistone Camper Hire collects and processes personal information provided by the hirer and authorised
drivers for the purposes of managing bookings, verifying eligibility to hire, complying with insurance
requirements, administering the rental agreement and defending any potential legal claims.
This may include, but is not limited to, driving licence details, DVLA check information, National Insurance
numbers and proof of address documentation.
Copies of identification and supporting documentation may be retained for up to 7 years for the purpose of
legal compliance, record keeping and the defence of legal claims.
Personal information will be handled securely and in accordance with applicable data protection legislation.
Penistone Camper Hire will not share personal information with third parties except where required for
legitimate purposes, including insurers, legal advisers, authorities or service providers involved in
administering the hire agreement.
Vehicle safety systems, including dash cameras, may collect information during the hire period for safety,
security and incident review purposes.
Dash cameras do not record audio.
Termination of Contract
The hirer acknowledges and accepts that Penistone Camper Hire reserves the right to terminate the
agreement and repossess the vehicle and its contents at any time without prior notification to the hirer if:
• The hirer is found to be in breach of any terms of the agreement
• The hirer has obtained the vehicle fraudulently or by misrepresentation
• The hirer does not return the vehicle at the agreed time and date
• Penistone Camper Hire considers that the safety of passengers or the vehicle is endangered
The hirer will be responsible for paying all reasonable costs incurred to repossess the vehicle.
Vehicle Substitution
Penistone Camper Hire reserves the right to substitute the vehicle for a similar or comparable vehicle at its
own discretion.
Collection and Parking
Hirers may leave their own vehicle at Penistone Camper Hire for the duration of the hire period. Vehicles are
left at the hirer’s own risk and Penistone Camper Hire accepts no liability for any loss, theft, damage or
possessions left within the vehicle whilst parked on the premises.
Due to the premises being a rented site, the hirer agrees when leaving their vehicle on site, vehicle keys must
be left with Penistone Camper Hire. This is to allow reasonable access to vehicles should movement be
required, including but not limited to requests from the site landlord, maintenance works, access
requirements or other reasonable operational needs.
Penistone Camper Hire will only move vehicles where reasonably necessary and will take reasonable care
when doing so. The hirer remains responsible for ensuring their vehicle is legally parked, roadworthy, insured
and suitable to be left on the premises for the duration of the hire period.
By leaving their vehicle and keys on site, the hirer confirms they give Penistone Camper Hire permission to
move the vehicle where reasonably required for the purposes stated above.
Title to Vehicle
The title to the vehicle remains with Penistone Camper Hire at all times and does not transfer to the hirer under
any circumstances.
The hirer is granted temporary use of the vehicle strictly under the terms of the agreement.
Any attempt by the hirer to claim ownership, sell, lease or encumber the vehicle will be considered a breach of
the agreement and may result in immediate termination of the hire contract and repossession of the vehicle.
